Rubbish Removal Kensington Service Terms and Conditions

These Terms and Conditions set out the basis on which Rubbish Removal Kensington provides rubbish removal and waste collection services to domestic and commercial customers. By booking a collection or otherwise using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions

1.1 In these Terms and Conditions, the following expressions have the meanings set out below:

1.1.1 Company, we or us means Rubbish Removal Kensington, the provider of rubbish removal and waste collection services.

1.1.2 Customer, you or your means the person, business or organisation requesting and paying for the services.

1.1.3 Services means any rubbish removal, waste collection, bulky waste clearance, garden waste removal, office or household clearance, and related services provided by the Company.

1.1.4 Premises means the property, building or site from which the waste is to be collected.

1.1.5 Waste means any materials, items, rubbish, junk or refuse that the Customer requests the Company to remove, excluding any prohibited items as described in these Terms and Conditions.

2. Scope of Services

2.1 The Company provides waste collection and rubbish removal services for domestic households, businesses and other organisations within our service area. The exact services available, including size and type of load, may vary depending on operational capacity and any specific quotation provided.

2.2 Services may include removal of general household rubbish, furniture, appliances, garden waste, builders waste and similar non-hazardous items, subject to applicable waste regulations and these Terms and Conditions.

2.3 We reserve the right to refuse collection of any items that we reasonably believe are hazardous, illegal, improperly packaged, too heavy or unsafe to move, or outside the scope of our licence or insurance.

3. Booking Process

3.1 Bookings for rubbish removal and waste collection can be made by telephone or through any other booking method we may make available from time to time.

3.2 When making a booking, you must provide accurate information, including:

3.2.1 Your full name and contact details.

3.2.2 The address of the Premises where the waste is to be collected.

3.2.3 Details of the type and approximate volume or weight of waste to be removed.

3.2.4 Any access restrictions, parking limitations or special circumstances at the Premises.

3.3 Any quote given prior to our arrival is based on the information you provide. If on arrival we find that the description, volume or weight of waste is different to that described at the time of booking, we may adjust the price accordingly or decline the service if it is not reasonably practicable or safe to proceed.

3.4 Bookings are subject to availability. Any time or date given for a collection is an estimate only and is not guaranteed. We will use reasonable efforts to attend during the agreed time window but are not liable for delays caused by traffic, weather, accidents, vehicle breakdown or other events beyond our reasonable control.

4. Access and Customer Responsibilities

4.1 You are responsible for ensuring safe and reasonable access to the Premises for our staff and vehicles at the agreed time of collection.

4.2 You must ensure that:

4.2.1 All waste to be collected is clearly identified and separated from items not to be removed.

4.2.2 The collection point is free from health and safety hazards, including but not limited to loose floor coverings, exposed cables, sharp objects and unsafe structures.

4.2.3 Any communal or restricted areas required for access have been authorised with the relevant property owner or managing agent.

4.3 If we are unable to carry out the collection because of insufficient access, unsafe conditions, or your failure to attend when required, we may at our discretion charge a call-out or wasted journey fee.

5. Pricing and Payment

5.1 Our charges are generally based on the volume and type of waste collected, measured by the space taken in our vehicle, and may include minimum load charges or additional fees for particular items.

5.2 We will usually confirm the final price on site once our staff have seen the waste and assessed the load size and work involved. If you agree to this price, we will proceed with the collection.

5.3 Unless otherwise agreed in writing, payment is due in full at the time of collection, upon completion of the service. We may accept payment by cash, bank card or other payment methods notified to you.

5.4 For business and account customers, alternative payment terms may be agreed in advance in writing. If such terms apply, invoices must be paid in full by the due date shown on the invoice.

5.5 If you fail to make any payment due to us by the due date, we may:

5.5.1 Charge interest on the overdue amount at the statutory rate allowable under UK law, accruing on a daily basis until payment is received in full.

5.5.2 Suspend or cancel any future collections for you.

6. Cancellations and Changes

6.1 You may cancel or request to reschedule a booking by contacting us as soon as reasonably possible.

6.2 If you cancel more than 24 hours before the scheduled collection time, any deposit paid may be refunded or applied to a future booking at our discretion, subject to any non-refundable costs we have incurred.

6.3 If you cancel less than 24 hours before the scheduled collection time or fail to provide access at the agreed time, we reserve the right to charge a cancellation fee which may be up to the full quoted price, to cover our costs and lost time.

6.4 We reserve the right to cancel or reschedule a booking at any time if:

6.4.1 We are unable to safely access the Premises.

6.4.2 The waste is materially different in nature or quantity to that described at the time of booking.

6.4.3 Weather or road conditions, vehicle breakdown or other circumstances beyond our reasonable control prevent us from attending.

6.5 In the event that we cancel a booking, our liability will be limited to refunding any sums you have already paid in respect of that booking. We are not liable for any indirect or consequential losses resulting from such cancellation.

7. Waste Types and Prohibited Items

7.1 We handle only those waste types that we are legally permitted and insured to collect and transport.

7.2 Prohibited items that we will not collect include, without limitation:

7.2.1 Asbestos or materials suspected to contain asbestos.

7.2.2 Clinical or medical waste, syringes or pharmaceutical products.

7.2.3 Corrosive, toxic, explosive, highly flammable or otherwise hazardous substances.

7.2.4 Pressurised gas bottles or cylinders unless previously agreed.

7.2.5 Certain chemicals, oils, paint, solvents or batteries not packaged or disclosed in advance.

7.3 If you present prohibited or hazardous items without prior disclosure, we may refuse to collect them and may still charge a call-out fee. If such items are discovered after collection, you will be liable for any additional costs, fines or penalties incurred by us as a result.

7.4 You warrant that all waste presented for collection is your property or that you have the authority of the property owner or occupier to arrange its removal.

8. Compliance with Waste Regulations

8.1 We operate in accordance with relevant waste management laws and regulations in the United Kingdom, including requirements to hold the appropriate waste carrier registration and to dispose of waste at authorised facilities.

8.2 Once payment has been made and the waste has been loaded onto our vehicle, ownership of the waste transfers to us and we will be responsible for its transport and disposal in line with applicable legislation.

8.3 We may issue a waste transfer note or other documentation where required. You must retain any such documentation as evidence of lawful waste transfer, particularly if you are a business customer.

8.4 We will use reasonable care to segregate and divert waste from landfill where practicable, including recycling and recovery options, but we do not guarantee that any particular item will be recycled or reused.

9. Liability and Insurance

9.1 We will exercise reasonable care and skill in providing the services. However, you acknowledge that moving bulky items, working in confined spaces or navigating access routes may carry a risk of minor damage.

9.2 You agree to remove or protect any items that may be vulnerable to damage during the collection process, including floor coverings, decorations and fragile objects. We are not liable for damage arising from pre-existing defects or wear and tear in your property.

9.3 Our liability for loss or damage to your property caused by our negligence will be limited to the reasonable cost of repair or replacement, taking into account age and condition, and subject to any applicable insurance limits.

9.4 We will not be liable for:

9.4.1 Any loss of profit, business, revenue, goodwill or anticipated savings.

9.4.2 Any indirect or consequential loss or damage, howsoever arising.

9.4.3 Any loss resulting from your failure to comply with these Terms and Conditions.

9.5 Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability which cannot be limited or excluded under applicable law.

10. Customer Indemnity

10.1 You agree to indemnify and keep us indemnified against any claims, losses, damages, fines or expenses we incur arising out of:

10.1.1 Your breach of these Terms and Conditions.

10.1.2 The presence in the waste of any prohibited, hazardous or misdescribed items.

10.1.3 Your failure to obtain any necessary permissions from property owners, landlords or managing agents for the removal of waste.

11. Complaints and Service Issues

11.1 If you are dissatisfied with any aspect of our service, you should contact us as soon as possible, providing full details of the issue.

11.2 We will investigate your complaint and aim to respond within a reasonable period. Where we find that we are at fault, we may, at our discretion, offer a remedy such as a partial refund, re-attendance or other proportionate solution.

12. Data Protection and Privacy

12.1 We may collect and process personal data about you, such as your name, contact details and service history, for the purposes of providing the services, handling payments, managing bookings and meeting our legal obligations.

12.2 We will handle your personal data in accordance with applicable data protection laws in the United Kingdom. Your details will not be sold to third parties. We may share information with payment processors, insurers, legal advisers or regulatory bodies where necessary.

13. Force Majeure

13.1 We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from any cause that is beyond our reasonable control, including but not limited to adverse weather, traffic disruption, strikes, lockouts, industrial disputes, acts of government, or failure of utilities or telecommunications.

14. Variation of Terms

14.1 We may update or amend these Terms and Conditions from time to time to reflect operational, legal or regulatory changes.

14.2 The Terms and Conditions in force at the time you make a booking will apply to that booking, unless a change is required by law or regulation in which case the updated terms may apply to existing bookings.

15. Severability

15.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed deleted and the remaining provisions shall continue in full force and effect.

16. Entire Agreement

16.1 These Terms and Conditions, together with any written quotation or confirmation of booking provided by us, constitute the entire agreement between you and us relating to the provision of the services and supersede any prior discussions, correspondence or understandings.

17. Governing Law and Jurisdiction

17.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them, including non-contractual disputes or claims, shall be governed by and construed in accordance with the laws of England and Wales.

17.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.

By proceeding with a booking or using our rubbish removal and waste collection services, you confirm that you have read, understood and agree to be bound by these Terms and Conditions.
